Terms and Conditions for Groups and Communities

The Union Européeen de radio-téléviosion/European Broadcasting Union, an association duly established under Swiss law, located at L'Ancienne-Route 17A, 1218 Grand-Saconnex (Geneva), Switzerland (hereafter, “EBU”, "us", "we" or "our") is managing the EBU expert groups and communities, including the meeting, events and other activities related to such expert groups and communities (the “Group(s)”).

These Terms and Conditions (the "Terms") apply to the registration, participation, online voting (if any) and cancellation/withdrawal in the Group(s), whether physical or virtual with the use of video or web conferencing tools (such as Teams, Zoom, etc.) or social media pages/platforms (such as WhatsApp, Facebook, etc.).

Some Groups may be created in connection with specific EBU departments, activities, meetings/events or initiatives and may continue to exist and operate before, during and/or after such activities, with scope and participation that may evolve over time.

Some Groups may also take the form of one-way communication channels (for example, announcement or broadcast groups on social media platforms such as WhatsApp), where participants receive information, updates or notifications from the EBU. Such channels may function similarly to subscription-based communications (e.g. newsletters) and may not be linked to an official EBU group or community as listed on the EBU website. In such cases, interaction between participants may be limited or disabled, and the purpose of the Group is primarily informational.

These Terms shall nevertheless apply to your access and use of any such Groups.

Registration, Access and Acceptance of Terms

Upon submitting a request to join a Group, or by joining, accessing or participating in it through any available means (including but not limited to social media platforms), you agree to be bound by these Terms without modification, and you enter a binding contract with us.

You acknowledge and agree that:

  • Groups may be joined either (a) through a formal request, registration or invitation process subject to our confirmation, or (b) directly via third-party platforms (including but not limited to WhatsApp, Teams, Facebook or similar tools), where applicable;
  • Certain Groups may be subject to additional specific conditions, rules or procedures communicated by the EBU, which shall apply in addition to these Terms;
  • Where you join or participate in a Group through a third-party platform, your use of such platform is also subject to that platform’s own terms and conditions and privacy policies, which are independent from these Terms and binding upon you.

If you join a Group on behalf of an entity, you agree to these Terms on behalf of that entity and you represent that you have the authority to do so. In such case, “you”, “your(s)” will also refer to that entity. If you do not have such authority, or if you do not agree to any provision of these Terms, please do not join the Group.

Participants' Conduct in a Group

We are dedicated to making our Groups a safe and respectful environment for all participants. By joining and participating in a Group, you agree to:

  • act in a respectful and professional manner towards all participants;
  • not display, share or promote any content, or engage in any conduct, that is threatening, libelous, defamatory, obscene, unlawful, or otherwise likely to give rise to civil or criminal liability;
  • not infringe the intellectual property, privacy, or other rights of any third-party;
  • not share any information that you know or reasonably should know is false, misleading or inaccurate;
  • not using the Group, any related infrastructure or platforms for unethical, illegal or malicious activities (including hacking or unauthorized access); and
  • not distribute or promote any own marketing or promotional materials during Group related meetings, events and/or activities without the prior written consent of the EBU.

We may request that you remove any content that we reasonably consider to be in breach of these Terms or otherwise inappropriate. You agree to comply with such request without undue delay and, where applicable, within the timeframe specified by us. Failure to comply with such request may result in the suspension or termination of your participation in the Group and/or in any related meeting, event or activity.

In case of physical Group meetings, events or activities, you are required to keep your personal belongings (including your computer and/or other devices) with you at all times, and we accept no liability for damage to, or loss of, personal belongings.

Suspension, Termination, Withdrawal

We may, at any time and at our sole discretion, with or without prior notice, suspend or terminate your access to or participation in a Group, and/or any related meeting, event or activity of the Group, in case of breach of these Terms or applicable laws, without incurring any liability towards you or any third party.

Please note that you remain entitled to withdraw from a Group on a voluntary basis at any time without providing any justification.

Withdrawal from a Group does not result in deletion of content previously shared within the Group by you or by other participants. Upon withdrawal or termination of your participation, you will no longer have access to the Group or to any Group Material, except to the extent such content has already been lawfully accessed or retained by you prior to your withdrawal.

Group Material

For the purposes of these Terms, “Group Material” includes any documentation, information, data, content or materials of any kind (such as without limitation, notes, records, studies, reports, messages, posts, files, presentations or other documents and tangible or intangible items including images, texts, comments, graphics, illustrations, etc.) made available, shared or exchanged by participants within a Group, including discussions and interventions of participants of the Group. The Group Material and all intellectual property rights therein are and shall remain our (or our licensors’) exclusive property.

Such Group Material is made available only to participants of the relevant Group and is provided for your personal and professional use within the context of that Group. You shall not reproduce, share, distribute or otherwise make any Group Material available to any third party outside of the Group without prior written authorization from the relevant copyright holder or disclosing party. These Terms do not grant you any license nor any right to use these elements made available to you except where such use is limited to the purposes of your attendance to the Group.

You acknowledge that Group Material may include confidential, sensitive and/or proprietary information. You are encouraged to exercise caution when sharing sensitive, confidential or personal data within Groups, in particular when using third-party platforms. You acknowledge, however, that the EBU does not control and cannot guarantee the confidentiality of information shared by participants within a Group, and any disclosure is made at the disclosing participant’s own risk. The EBU shall not be responsible for any disclosure of use of such shared material by any participant.

Photography, Recording and Filming

By registering and/or by participating to a Group, wherever physically or virtually via video conferencing or web conferencing or social media platforms/tools, you acknowledge that certain meetings, events, sessions and/or social functions may be, photographed and/or filmed and/or web streamed and that some of these photos and video recordings can be used for the minutes/summary of the meeting or event, news, promotional purposes, current and/or future marketing materials, illustration, information and dissemination activities via EBU’s own websites or inclusion on EBU’s social media pages which may process personal data according to their own policies. In some cases, online audio and/or video recordings are accessible only to EBU Members via log-in.

Participation in a Group indicates your consent to being included in such recordings. Should you have any concerns about this, or do not wish to be featured in any of these materials, please approach the EBU staff member responsible for and managing the Group. However, you are advised that incidental inclusion of some images of yourself within any listening and/or recording or photograph(s) may take place. Photograph(s), audio and/or video listening(s) and/ or recording(s) will be publicly available.

Payment of Fees (where applicable)

If some activities of a Group (e.g., meetings or events organized/managed by the Group) you are joining are not free of charge, you undertake to pay the relevant fees (all taxes included) where applicable. The fees shall be paid in accordance with the conditions set out on the registration form, as otherwise communicated by us, or in accordance with the payment terms as set out on the invoice.

Travel and Accommodation / Dietary Requirements (where applicable)

In case of physical meetings, events or other Group related activities, you are solely responsible for making and bearing all costs associated with your travel and accommodations arrangements. You are also responsible for complying with any applicable travel, visa, entry or health requirements, and are encouraged to verify such requirements with the relevant local authorities. We shall not be liable for any travel or accommodation arrangements, formalities, costs or expenses, nor for your inability to attend, including in the event of Force Majeure. We recommend that you secure appropriate insurance coverage, including travel cancellation, health and accident insurance.  cancellation as well as adequate health and accident insurance.

Assistance (where applicable) 

If you need any special assistance (e.g. in relation to a person who is blind/visually impaired or a person with a physical disability), please contact the EBU staff member responsible for the relevant Group by email to arrange assistance.

Online voting (where applicable)

By joining a Group, you may participate in meetings or activities involving online voting.

In this context, for the organisation and management of the voting process, certain personal data pertaining to you may be processed by us in accordance with the Privacy Notice for EBU Groups and Communities. Such processing may involve the transfer of your data to a third-party online voting platform provider in order to enable your participation in the vote (including receiving a voting invitation, registering and casting your vote). Where you stand as a candidate for an election within the Group (or related meeting, event or Group activity), any information you choose to provide in that context (such as your name, photo, biography or motivation statement) may also be processed and shared for the purposes of the voting process.

Your use of any such online voting platform is also subject to the terms and conditions and privacy policy of the relevant provider.

Voting results may be presented in summary form, and their calculation may vary depending on the rules of each Group. For more information, please contact the relevant Group or Community responsible.

Data Protection

By joining and participating to a Group, wherever physically or virtually via video conferencing or web conferencing or social media platforms/tools, you acknowledge that your personal data may be collected and processed by us (including being shared with third parties which may also collect and process personal data for their own purposes under their own terms and conditions and privacy policies, as the case may be, for which we are not liable), in order to manage your participation in the Group, as further detailed in our Privacy Notice for EBU Groups and Communities.

ARTIFICIAL INTELLIGENCE (AI)

As part of the features made available in connection with a Group, we may use or provide access to tools based on artificial intelligence (AI) to generate, process or support certain content or functionalities, including but not limited to transcriptions, summaries, translations or other outputs related to Group Material and participants’ exchanges.

Where such AI-generated tools are used, the resulting outputs (including, where applicable, transcriptions and translations) are provided to you for convenience only and may not be subject to human review. As a result, they may contain errors, omissions or inaccuracies and, we recommend you not to rely on such outputs as authoritative or definitive.

The EBU shall not be liable for any inaccuracies, errors or omissions in such AI-generated outputs, and you hereby agree to waive any and all claims against EBU for any such inaccuracies, errors or omissions. 

In case of doubt, or where you find the output inappropriate or inaccurate, you are encouraged to verify the relevant information and/or contact the Group staff member responsible.

We may also use AI-generated tools to translate these Terms for your convenience. In case of any discrepancy, the English version of these Terms shall prevail.

LIABILITY

To the extent permitted by law, the EBU, its affiliated companies, and any third-party service providers (including, without limitation, video conferencing, web conferencing or social media platforms) shall not be liable, whether in contract, tort or otherwise, for any damages arising out of or in connection with your access to, registration for, or participation in a Group, and any related meeting, event or activity of such Group. In particular, the EBU shall not be liable for:

  • any incidental, consequential, punitive or otherwise indirect damages, including but not limited to loss of profits, loss of data, loss of opportunity or additional costs;
  • any Group Material, including without limitation content, information, opinions or materials shared by other participants, which are provided for general information purposes only, are not verified by the EBU and do not constitute professional or other advice;
  • any decisions made or actions taken by you or any third party based on such content or information; you expressly acknowledge that any reliance on information shared within a Group is at your own risk.
  • any unavailability, disruption, security issue or malfunction of third-party platforms or tools;
  • any loss, interception, unauthorized access or use of data, content or communications on systems not controlled by the EBU;
  • any cancellation, postponement or modification of a Group or related meeting, event, or activity of such Group, as well as your inability to attend;
  • any circumstances beyond our reasonable control, including Force Majeure.

Any Group, in particular where hosted on third-party platforms, is provided on an “as is” and “as available” basis, without any warranty of any kind, whether express or implied, including (without limitation) warranties of accuracy, completeness, reliability, availability, fitness for a particular purpose or non-infringement.

You remain solely responsible for: (i) ensuring that you have the necessary equipment, access and authorizations to participate; and (ii) any content, material or information you upload, share or make available, including obtaining all necessary rights. You agree to indemnify and hold harmless the EBU from any third-party claims arising from such content.

If, notwithstanding the foregoing, the EBU is found liable, in any event the EBU’s total liability shall be strictly limited to the fees (if any) paid by you in connection with the relevant Group or any related meeting, event, or activity of such Group.

Nothing in these Terms shall exclude or limit liability where such limitation is not permitted under applicable law.

THIRD-PARTY PLATFORMS

You may be required to register for and/or participate in a Group (including meetings, events or other Group related activities) via third-party websites, applications or platforms (including, without limitation, social media and video/web conferencing tools). We do not control and make no representations or warranties in relation to such third-party platforms, including their availability, security. In particular, we shall not be responsible for the availability, security, functionality or any content or data processing carried out by them. Your use of such platforms is at your own risk and is subject to the applicable terms and conditions and privacy policies of the relevant third-party provider. Any agreement you enter into with such third parties is solely between you and the relevant provider. The EBU shall not be responsible or liable for any loss, damage or issue arising from your use of such third-party platforms, and you agree to seek any remedy directly from the relevant provider.

FORCE MAJEURE

We will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations under these Terms that is caused by Force Majeure. “Force Majeure” shall mean any event which is beyond our and/or your reasonable control, including but not limited to, Act of God, fire, flood, lightening, storm, earthquake or other climatic or meteorological catastrophes, failure or delay of common carrier or impairment or lack of adequate transportation facilities, accident or repair to machinery, act of sabotage including but not limited to piracy or hacking, embargo, government requirement or action including the imposition of sanctions by any country against Switzerland or a country in which a party is registered or a country in which a Group related event or meeting or activity is deemed to take place, war, civil or military authority, terrorism and industrial dispute, strike or labor disturbance, regulatory change or change in law, or any event or circumstance which puts at risk or endangers the health, safety or security of our and/or your personnel, which prevents and/or affects the performance of these Terms, and could not have been prevented, avoided or remedied by the party affected by the Force Majeure taking reasonable precautions. Please note that in case of Force Majeure, there will be no reimbursement of any fees already paid in relation to the Group.

UPDATE OF TERMS, GOVERNING LAW AND JURISDICTION

These Terms are the latest version in effect and replace any previous version. We may update these Terms at any time. Consequently, you are invited to regularly refer to the latest Terms in effect when you join a Group. You agree that these Terms will be exclusively governed by the laws of Switzerland. Any dispute, claim or controversy arising out of, connected with or relating to the conclusion, validity, interpretation or performance of these Terms will be under the exclusive jurisdiction of the competent courts of the Canton of Geneva, Switzerland.
