The revised Audiovisual Media Services Directive (AVMSD) ensures that media service providers’ programmes and services are protected against any modifications made without their consent. In a market where platforms are increasingly distributing audiovisual content, the protection of content integrity helps to reinforce trust in media service providers’ content and prevents exploitations by third parties (e.g. through commercial overlays).
While new Art. 7b AVMSD lays down the principle, it leaves some discretion to Member States when transposing the Directive in national law, as regards the scope of the protection, possible exceptions or the question of jurisdiction. With our discussion paper, we would like to contribute to the debate and ensure effective implementation of the Directive’s new rule.
